Stiven Peralta
Passaic County Prosecutor Camelia M. Valdes and Passaic Police Chief Luis A. Guzman announce the arrest of Stiven Peralta, 22 years old, from Passaic, New Jersey. Mr. Peralta was charged on September 14, 2023 after an investigation conducted by the Passaic Police Department and the Passaic County Prosecutor’s Office Special Victims Unit.
Mr. Peralta is charged with one count of first-degree aggravated sexual assault, in violation of N.J.S.A. 2C:14-2(a)(3); one count of second-degree sexual assault, in violation of N.J.S.A. 2C:14- 2(c)(1); and one count of second-degree aggravated assault, in violation of N.J.S.A. 2C:12-1(b)(13); one count of third-degree aggravated assault, in violation of N.J.S.A 2C:12-1(b)(12); one count of third-degree endangering the welfare of a child, in violation of N.J.S.A. 2C:24-4(a)(2); one count of third-degree criminal restraint, in violation of N.J.S.A. 2C:13-2(a); one count of fourth-degree resisting arrest, in violation of N.J.S.A. 2C:29-2(a)(2); one count of disorderly persons offense of false imprisonment, in violation of N.J.S.A. 2C:13-3. It is alleged that on September 12, 2023, Mr. Peralta sexually assaulted and repeatedly physically assaulted a child at a residence in Passaic, restraining the child when she attempted to leave the residence. On September 13, 2023, at approximately 12:40 a.m., Peralta was taken into custody without incident in the area of Washington Place and Columbia Avenue in Passaic, New Jersey.
The sentencing exposure on a first-degree aggravated sexual assault is 10 to 20 years in New Jersey State prison, with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on a second degree sexual assault, it is 5 to 10 years in New Jersey State Prison, with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on second-degree aggravated assault, it is 5 to 10 years in New Jersey State Prison, with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on a third-degree aggravated assault, it is 3 to 5 years in New Jersey State Prison; on a third-degree endangering the welfare of a child, it is 3 to 5 years in New Jersey State Prison; on a third-degree criminal restraint, it is 3 to 5 years in New Jersey State Prison; on a fourth-degree resisting arrest, it is up to 18 months in New Jersey State Prison; and on a disorderly persons false imprisonment, it is up to 6 months in county jail. If convicted, Mr. Peralta would be to subject Megan’s Law registration requirements and Parole Supervision for Life.
Mr. Peralta is currently in custody at the Bergen County Jail. The Passaic County Prosecutor’s office has filed a motion for pretrial detention, which will be scheduled before a Superior Court Judge.
A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
