Arrest Made in Connection With July 4, 2023 Shooting Investigation

Passaic County Prosecutor Camelia M. Valdes and Paterson Police Department Officer-In-Charge Isa Abbassi announce that based upon an investigation by the Paterson Police Department, in conjunction with the Passaic County Prosecutor’s Office, Anderson Martinez, 26- years-old from Paterson, was arrested in relation to a shooting investigation that took place on July 4, 2023, in the area of Essex Street and Madison Street in Paterson, New Jersey. Anderson Martinez is charged with Attempted Murder, First Degree; Unlawful Possession of a Handgun, Second Degree; Possession of a Weapon for an Unlawful Purpose, Second Degree; Certain Persons Not to Have Weapons, Second Degree; and Aggravated Assault, Second Degree.

At approximately 11:34 p.m. on July 4, 2023, members of the Paterson Police Department were advised that a 20-year-old male Paterson resident and a 19-year-old male Paterson resident had arrived at Saint Joseph’s University Medical Center in Paterson, New Jersey, via private vehicle, each seeking treatment for a non-fatal gunshot wound. Based on the investigation, it was determined that the victims were struck by gunfire in the area of Essex Street and Madison Street in Paterson. A potential crime scene was located in that area.

Through the course of the investigation, Paterson Police identified Anderson Martinez as the shooter and a warrant was issued for his arrest. Members of the Paterson Police Department arrested Anderson Martinez at approximately 3:00 a.m. on July 26, 2023, in the area of 21st Avenue and Chestnut Street in Paterson.

The sentencing exposure for Anderson Martinez on First Degree Attempted Murder is 10-20 years New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act and 5 years parole supervision; on Second Degree Unlawful Possession of a Handgun it is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act; on Second Degree Possession of a Handgun for an Unlawful Purpose it is 5-10 years New Jersey State Prison with 42 months of parole ineligibility pursuant to the Graves Act; on Second Degree Certain Persons Not to Have Weapons it is 5-10 years New Jersey State Prison with 5 years of parole ineligibility; and on Second Degree Aggravated Assault it is 5-10 years New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act and 3 years parole supervision.

The State intends to file a motion for the pretrial detention of Anderson Martinez, which will be heard by a Superior Court Judge.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
