Arrests Made in Connection With May 22, 2023 Shooting Investigation

Passaic County Prosecutor Camelia M. Valdes and Paterson Police Department Officer-In-Charge Isa Abbassi announce that based upon an investigation by the Paterson Police Department, in conjunction with the Passaic County Prosecutor’s Office, Jazyre K. Kearney, 21- years-old from Paterson, and Tommy Norberto, 20-years-old from Teaneck, New Jersey, were arrested in relation to a shooting investigation that took place on May 22, 2023, in the area of West Broadway and Matlock Street in Paterson, New Jersey. Jazyre K. Kearney and Tommy Norberto are charged with two counts of Attempted Murder, First Degree; Unlawful Possession of a Handgun, Second Degree and Possession of a Weapon for an Unlawful Purpose, Second Degree. Tommy Norberto is also charged with Certain Persons Not to Have Weapons, Second Degree.

Jazyre K. Kearney is also charged with Possession of a Weapon for an Unlawful Purpose, Second Degree; Unlawful Possession of a Weapon, Second Degree; and Hindering Apprehension, Third Degree in relation to his July 19, 2023 arrest.

At approximately 6:07 p.m. on May 22, 2023, Paterson Police responded to the area of West Broadway and Matlock Street in Paterson, New Jersey on a report of shots fired. Paterson Police located a potential crime scene as well as a 37-year-old female Paterson, New Jersey resident suffering from a non-fatal gunshot wound. Aid was immediately rendered, and she was transported to St. Joseph’s University Medical Center in Paterson, New Jersey for treatment. A short while later, a 35-year-old male East Orange, New Jersey resident arrived at St. Joseph’s University Medical Center in Paterson, New Jersey via private vehicle seeking treatment for a non-fatal gunshot wound.

Through the course of the investigation, Paterson Police identified Jazyre K. Kearney and Tommy Norberto as the shooters and warrants were issued for their arrets. On May 26, 2023, at approximately 11:46 a.m., members of the Paterson Police Department arrested Tommy Norberto in the area of Prospect Street and Passaic Street in Passaic, New Jersey.

On July 19, 2023 at approximately 11:54 p.m., members of the Paterson Police Department arrested Jazyre K. Kearney during a motor vehicle stop the area of Madison Avenue and Broadway in Paterson, New Jersey. At the time of his arrest, Jazyre K. Kearney possessed an unlawful handgun and provided a false name to police.

The sentencing exposure for Jazyre K. Kearney and Tommy Norberto on each count of First Degree Attempted Murder is 10-20 years New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act and 5 years parole supervision; on Second Degree Unlawful Possession of a Handgun it is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act; and on Second Degree Possession of a Handgun for an Unlawful Purpose it is 5-10 years New Jersey State Prison with 42 months of parole ineligibility pursuant to the Graves Act. The exposure for Tommy Norberto on Second Degree Certain Persons Not to Have Weapons is 5-10 years New Jersey State Prison with 5 years of parole ineligibility. The exposure for Jazyre K. Kearney on the addition count of Second Degree Unlawful Possession of a Weapon is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act, on the additional count of Second Degree Possession of a Weapon for an Unlawful Purpose it is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act; and on Third Degree Hindering Apprehension it is 3-5 years New Jersey State Prison.

On June 1, 2023, the Honorable Joseph A. Portelli, J.S.C., granted the State’s motion for the pretrial detention of Tommy Norberto after a hearing.

On July 20, 2023, the State filed a motion for the pretrial detention of Jazyre K. Kearney, which will be heard by Judge Portelli on July 25, 2023.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
