Arrest Made in Connection With February 4 2023 Robbery Investigation

Passaic County Prosecutor Camelia M. Valdes and Passaic Police Chief Luis A. Guzman announce that based upon an investigation by the Passaic Police Department, Jairo Ramirez-Abreu, 31 years old, from Passaic, New Jersey, was arrested in relation to a shooting/robbery investigation that took place February 4, 2023, at the intersection of Ninth and South Streets in Passaic, New Jersey. Jairo Ramirez-Abreu is charged with Attempted Murder, First Degree; Robbery, First Degree; Unlawful Possession of a Weapon, Second Degree; Possession of a Weapon for an Unlawful Purpose, Second Degree; Aggravated Assault, Second Degree; Possession of a Large Capacity Magazine, Fourth Degree; and Possession of a Defaced Firearm, Fourth Degree.

On February 4, 2023, at approximately 4:59 a.m., members of the Passaic Police Department responded to the area of Ninth Street and South Street after they were advised of a shooting. Upon arrival, officers encountered a 54-year-old male suffering from a non-fatal gunshot wound, and he was immediately transported to Saint Joseph’s University Medical Center in Paterson for treatment.

Upon investigation, it was determined that Jairo Ramirez-Abreu and an unknown individual exited a vehicle and accosted the victim, grabbing the victim’s bookbag. During the struggle, the victim sustained a non-fatal gunshot wound.

On February 7, 2023, at approximately 11;49 a.m., members of the Passaic Police Department conducted a motor vehicle stop in the area of Howard Avenue and Main Avenue in Passaic, New Jersey. During the motor vehicle stop Jairo Ramirez-Abreu was found to be in possession of a loaded handgun and was arrested. The State originally filed for detention on the handgun charge that was to be heard February 13, 2023. However, subsequent investigation linked Mr. RamirezAbreu to the February 4, 2023 Robbery/Shooting investigation. Additional charges were subsequently filed against Mr. Ramirez-Abreu in relation to the February 4, 2023 incident.

The sentencing exposure for Jairo Ramirez-Abreu on First-Degree Attempted Murder is 10-20 years New Jersey State Prison with 85% of that term to be served before parole eligibility pursuant to the No Early Release Act and five years parole supervision after release; on First-Degree Robbery it is 10-20 years New Jersey State Prison with 85% of that term to be served before parole eligibility pursuant to the No Early Release Act and five years parole supervision; on SecondDegree Unlawful Possession of a Handgun it is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act; on Second-Degree Possession of a Handgun for an Unlawful Purpose it is 5-10 years New Jersey State Prison with 42 months of parole ineligibility pursuant to the Graves Act; on Aggravated Assault, Second Degree it is 5-10 years New Jersey State Prison with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; on Possession of a Large Capacity Magazine, Fourth Degree it is up to 18 months New Jersey State Prison; and on Possession of a Defaced Firearm, Fourth Degree it is up to 18 months New Jersey State Prison.

The State intends to file a motion for pretrial detention on the new charges that will be heard by a Superior Court Judge.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
