Passaic Man Arrested for Sexual Assault and Kidnapping of a Child

Passaic County Prosecutor Camelia M. Valdes and Passaic Police Chief Luis A. Guzman announce the arrest of Oscar Fuentes-Sierra, 44 years old, from Passaic, New Jersey. Mr. Fuentes-Sierra was arrested without incident on January 17, 2023, after an investigation conducted by the Passaic County Prosecutor’s Office Special Victims Unit.

Mr. Fuentes-Sierra is charged with two counts of first degree Aggravated Sexual Assault, in violation of N.J.S.A. 2C:14-2(a)(1) and N.J.S.A. 2C:14-2(a)(3); one count of first degree Kidnapping, in violation of N.J.S.A. 2C:13-1(b)(1); one count of second degree Sexual Assault, in violation of N.J.S.A. 2C:14-2(b); and one count of third degree Endangering the Welfare of a Child, in violation of N.J.S.A. 2C:24-4(a)(1). It is alleged that on one occasion between January 2021 and February 2021, Mr. Fuentes-Sierra confined and sexually assaulted a five-year-old girl in his car while the vehicle was parked in Passaic. It is alleged that Mr. Fuentes-Sierra was acquainted with the child.

The sentencing exposure on a first degree Kidnapping is twenty-five years to life in New Jersey State Prison, subject to a twenty-five year term of parole ineligibility, when the victim is less than sixteen years old; on a first degree Aggravated Sexual Assault, it is twenty-five years to life in New Jersey State Prison, subject to a twenty-five year term of parole ineligibility, when the victim is less than thirteen years old; on a second degree Sexual Assault, it is five to ten years in New Jersey State Prison, with 85% of the term to be served before parole eligibility pursuant to the No Early Release Act; and on a third degree Endangering the Welfare of a Child, it is three to five years in New Jersey State Prison. If convicted, Mr. Fuentes-Sierra would be to subject Megan’s Law registration requirements and Parole Supervision for Life. The State has filed a motion for pre-trial detention.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
