Bergen County Prosecutor Mark Musella announced the arrest of ROBERT SETNITZKY (DOB: 09/03/1962; single; unemployed) of 100 Chestnut Ridge Road, Room 116, Montvale, NJ, currently incarcerated at Northern State Prison, on the charge of possession of child sexual abuse material. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Jason Love.

On Thursday, July 13, 2023, members of the Bergen County Prosecutor’s Office Cyber Crimes Unit were contacted by New Jersey State parole officers regarding a parolee who violated the terms of his release and was believed to be in possession of child sexual abuse material. SETNITZKY was arrested on July 13, 2023, in Montvale, NJ by parole officers for violating conditions of his release.

Subsequently, the Bergen County Prosecutor’s Office Cyber Crimes Unit conducted an investigation that involved a search of SETNITZKY’s electronic devices, which revealed that SETNITZKY viewed, downloaded, and/or possessed items depicting nude and/or sexually explicit prepubescent and pubescent children. As a result of the investigation, on January 5, 2024, ROBERT SETNITZKY was charged with third-degree possession of child pornography, N.J.S.A. 2C:24-4b(5)(b)(iii). SETNITZKY was served with a complaint-warrant at the Northern State Prison, where he remains in custody.

Prosecutor Musella states that the charge is merely an accusation and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt. Prosecutor Musella thanks the New Jersey State Division of Parole for their assistance with the investigation.
