At approximately 12:20 a.m. on October 13, 2024, the Bayonne Police Department was notified of a pedestrian struck in the area of Route 440 and 22nd Street. Responding officers located a male victim, later identified as a 34-year-old Bayonne resident, with life-threatening injuries. The striking vehicle did not remain at the scene. The male was transported to Jersey City Medical Center, where he remains in critical condition.

During the investigation, it was determined Toon and the victim were involved in an altercation on the shoulder of Route 440.
